Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the The Murmur mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and The Murmur ("we", "us", or "our"). Use of the App is also governed by our Privacy Policy and End User License Agreement (EULA), which are incorporated by reference.

2. Service Description

The Murmur is an iOS application that allows users to:

• Search for public Instagram profiles
• View publicly available profile information (username, bio, follower count)
• Post anonymous comments on Instagram profiles visible to other The Murmur users
• Reply to, like, and delete their own comments
• View a weekly leaderboard of top-liked anonymous comments

The Murmur is an independent platform. Comments posted on The Murmur are not visible on Instagram. The Murmur does not post on Instagram on your behalf and is not affiliated with Meta Platforms, Inc.

3. Eligibility

You must be at least 13 years old to use The Murmur. If you are under 18, you represent that you have permission from a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

If you are located in a jurisdiction where the age of digital consent is higher (e.g., 16 in many EU member states), you must meet that higher age requirement.

4. Your Account

The Murmur does not require you to create a traditional account with a username and password. Instead, the App generates an anonymous identity tied to your device. You are responsible for keeping access to your device secure, as anyone with access to your device can post on your behalf.

Your anonymous username is assigned automatically and cannot be changed. You may not attempt to impersonate another user or manipulate the identity system.

5. User Conduct

You agree to use The Murmur only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Post content that is false, misleading, or defamatory
• Harass, bully, threaten, or intimidate any individual
• Post content that is sexually explicit or pornographic
• Incite or promote violence, self-harm, or illegal activity
• Post content that discriminates against or degrades individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Attempt to de-anonymize other users or disclose their real identities
• Use the App to stalk, monitor, or target specific individuals
• Scrape, crawl, or systematically extract data from the App or its API
• Circumvent, disable, or interfere with rate limiting, authentication, or other security features
• Use automated bots or scripts to post comments or likes
• Reverse-engineer, decompile, or disassemble the App

6. Prohibited Content

The following types of content are strictly prohibited and will be removed:

• Child Sexual Abuse Material (CSAM) — zero tolerance; will be reported to relevant authorities
• Credible threats of violence against identifiable individuals or groups
• Personal information (doxxing) — posting private addresses, phone numbers, or identifying information of others
• Spam and coordinated inauthentic behavior
• Content that violates applicable law in the user's or our jurisdiction

We reserve the right — but have no obligation — to monitor, review, or remove any content at our sole discretion without notice.

7. Content Moderation

The Murmur may implement automated or human content moderation. Because comments are anonymous, moderation is based on the content of the comment itself, not the identity of the poster.

Users who repeatedly violate these Terms may have their anonymous identity suspended or banned. Suspension is based on the hashed device identifier; a banned device will be unable to authenticate with the service.

8. Intellectual Property

The The Murmur application, its design, code, and branding are the intellectual property of The Murmur and are protected by applicable copyright, trademark, and other laws.

By posting a comment on The Murmur, you grant us a worldwide, non-exclusive, royalty-free license to store, display, and distribute that comment within the App and on associated leaderboards. You retain any underlying rights you may have in your comments.

You represent that you own or have the right to post any content you submit, and that such content does not infringe any third-party intellectual property rights.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or free of viruses
• Warranties regarding the accuracy or reliability of any content or data obtained through the App

We do not endorse, verify, or take responsibility for user-generated content posted through the App.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MURMUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (IF ANY) OR (B) $10 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless THE MURMUR and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Content you submit through the App
• Your violation of any third-party rights

13. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately.

You may stop using the App at any time by uninstalling it. If you wish to request deletion of your data, see our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which The Murmur is registered, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
